Both Mr. Brooks and Ms. Concepcion have extensive experience in this area of law.   They have assisted clients with administering estates through the judicial process, represented clients in prosecuting and defending against will contests, and determination of heirship. 

Both Mr. Brooks and Ms. Concepcion have extensive experience in real estate law.  The firm represented corporate and individual clients including estate administrators in probate proceedings with various real estate matters including but not limited to, preparing and reviewing purchase contracts and leases for both residential and commercial properties, conducting due diligence, prosecuting or defending in quiet title actions, pursuing land registration petitions, and preparing various types of deeds.   The firm has assisted clients with applications under the Horizontal Property Regime act wherein existing hotel or apartment buildings are converted to condominium units.   

The firm has provided and continues to provide collections and bad debt recovery services relating to bankruptcy, repossession, probate, foreclosure, real estate, pre-litigation/small claims/civil litigation.  At least half of Mr. Brooks’ caseload consists of collections and bad debt recovery.  Mr. Brooks is and must be familiar with the Fair Debt Collectors Practices Act (FDCPA), Telephone Consumer Protection Act (CPA), Fair Credit Reporting Act (FCRA), Consumer Financial Protection Act (CFPA, Soldiers’ and Sailors’ Civil Relief Act (SCRA) as these statutes affect collection matters in one way or another.  Ms. Concepcion represented a California Trustee in recovering real property conveyed in violation of Bankruptcy law in an Adversary Proceeding before the U.S. District Court of Guam.

Ms. Concepcion is a member of the Society of Human Resource Management (“SHRM”) and the Guam SHRM Chapter for the last ten (10) years and a member of the American Bar Association’s Employment and Labor Law Group. The firm has experience in advising both private and government agencies regarding employment and labor law matters.  Ms. Concepcion primarily handles such matters.  Ms. Concepcion has successfully represented corporate clients in litigation involving Workers' Compensation Insurance coverage and Equal Employment Opportunity charges.  Ms. Concepcion has advised government agencies regarding related government of Guam personnel rules and regulations involving classified and unclassified employees. In addition, Ms. Concepcion has appeared before the Guam Civil Service Commission on behalf of several government of Guam employees in adverse action proceedings.

The firm has assisted government agencies in drafting and reviewing legislation, administrative rules, and regulations.  The firm assisted  agencies in amending their enabling acts in preparation.  The firm also assisted the GSWA Board of Directors in drafting, holding public hearings, and promulgating its governing rules under the Administrative Adjudication Law.  Mr. Brooks assisted GEDA in amending its Bylaws.  The firm has provided legal opinions regarding interpreting and applying existing laws, rules, and regulations. Mr. Brooks has also been a member of several government boards, the PUC and GEPA, and is familiar with how government boards operate, applicable laws, administrative rules and regulations. 

The firm has assisted several government agencies and private companies with procurement and FOIA matters.  The firm has represented government agencies and private entities in procurement protests before the Office of Public Accountability.   

The firm has experience in rate setting and rule making. Mr. Brooks served on the PUC for nearly 20 years and was involved in creating the levelized fuel adjustment clause and ending the Navy/GPA power pool agreement. He also sued the PUC after he left the commission to overturn a PUC order attempting to force GWA to pay $20 million to the government of Guam. The firm has assisted government agencies with the drafting and promulgation of administrative rules pursuant to the Administrative Adjudication Law’s rule making procedure.                                     

Ms. Concepcion has sat as an administrative law judge for the Guam Environmental Protection Agency and the Department of Public Health and Social Services, following the Administrative Adjudication Law hearing procedures.  Ms. Concepcion represented an aircraft pilot in an administrative hearing before the US Department of Labor, Office of Administrative Judges, which required the interpretation and application of Federal Aviation Administration rules and regulations.   Most recently, the firm is local counsel along with  admitted co-counsels in representing, a Philippine corporation, before the US District Court of Guam in a case  involving  FAA laws and administrative regulations. 

The firm provides litigation services to both its government and private clients. Ms. Concepcion primarily provides such services to the firm’s clients. The firm has initiated and defended against civil complaints involving breach of contract, shareholder derivative actions, quiet title, declaratory judgment, petitions for partition, land registration, torts, fraud, employment and labor law, collections, and bankruptcy proceedings.   

The firm has represented numerous landlords, both corporate and individuals, in unlawful detainer actions and collection of rent. The firm handles hundreds of collection matters and creditors in bankruptcy proceedings.  Mr. Brooks primarily handles such matters as he has over 40 years of experience in collections and bad debt recovery.

The firm has represented both plaintiffs and defendants in breach of contract matters before trial and appellate courts.   The firm successfully represented two victim claimants in a cryptocurrency Ponzi scheme in the US District Court of  Guam.   Most recently, the firm represented a Philippine corporation, before the US District Court of Guam in a civil forfeiture proceeding.   

The firm has represented private companies in arbitration proceedings involving the enforcement of contractual obligations before local arbitration panels and JAMS.
